On pain from being excluded from insurance coverage, the lessee agrees not to permit the vehicle to be driven by anyone other than him/herself. He/she undertakes that the vehicle will not be used
a) For paid carriage of passengers and in races
b) To push or tow any vehicle or any trailer.
c) By anyone under the influence of drugs or alcohol.
d) For illegal purposes or carriage of goods.
e) While overloaded for example carrying passengers than permitted by the registration papers.
f ) The lessee undertakes to keep the said vehicle closed and locked when not in use, keeping in his/her possession the vehicle’s papers which shall in no case be left in the vehicle. The lessee therefore agrees to make use of the into theft device wherever leaving the car parked.
g) The lessee shall in no event assign mortgage or pledge this contract, the vehicle, it’s equipment or tools, or treat the same way in any condition detrimental to the lesser.
Any infraction of any of these undertaking empowers the lessor to demand return of the vehicle fore with.
The lessee acknowledges that he/she received said vehicle in a proper condition and clean.
The five tyres are in good condition, without punctures. In the event of damage to any of them by any use other than normal wear the lessee agrees to replace the same forth with at his expense with a type of the same dimension and equivalent state of wear.
The price and rental payments are determined by applicable rate lists and payable in advance. The lessee to return the vehicle to the rental agent on the date specified in the rental agreement. Return of the vehicle by the lessee to the rental agent at the designated location alone terminate the contract.
The lessee undertakes the state of the rental agent his home address.
Anyone whose reference appears on the driving ares on the reverse of this page and the driver commits him/herself to pay the charges below
a) The rental time charges, the special accident insurance premiums on the reverse side of this contract.
b) A sum limited to the applicable rate list for repair of possible damage caused to the vehicle of the lessee did not agree to pay the change due in case of the reduction of the deduction.
This acceptance is materialized by the lesser initials in box provided for such purpose on the reverse side thereof.
c) Any and all files, charges, costs, and taxes for any and all the infringement of traffic, parking, or other laws of which the vehicle, the lessee or the lessor is responsible during the term of this contract ecept however for infringements from fault of the lessor’s part.
1. The lessee hereby approves and undertakes to observe the terms and conditions thereof. The lessee further agrees to take all necessary steps to protect the interest of the lessor and it’s insurance company in case of accident during term of this Rental Contract.
a) To report to EMARS TRANSPORT & TOURS LTD are within 24 hours of any accident, theft or fire.
b) To include in his report, the circumstance, date, place and time of the accident, the name of such owners, insurance company and the policy number.
c) To attach to such report any available police or bailliff reports.
Not to, on the event of an accident, discuss or accept liability, deal or settle with parties relative to the accident
d) Carried clothing or other articles are not covered.
2. The vehicle is insured only for rental period shown on the reverse side of the receipt. Therefore, unless an extension is agreed to, the lessor declines all responsibility for any accident which the lessee may have caused and for which he alone shall be responsible.
EMARS TRANSPORT & TOURS LTD declines all responsibility for objects left in the vehicle during the rental period.
3. The damage resulting from bad conditions of the use of vehicle for example poor or uneven road will be borne by the lessee.
4. EMARS TRANSPORT & TOURS LTD declines all responsibility for injury to third parties or damage to the vehicle which the lessee may cause during the rental period if he has willfully supplied by EMARS TRANSPORT & TOURS LTD with false information as to identity, his/her address or the validity of his/her drivers’ license. In that case, the lessee is not covered by the insurance policy.
Normal mechanics wear is for account of EMARS TRANSPORT & TOURS LTD if the vehicle should be laid up, the repairs nay be made only with the written agreement and according to instructions to EMARS TRANSPORT & TOURS LTD once undertaken they must be covered by, to a receipted and itemized bill, with which replaced defective parts must be presented.
The lessee must make a standing check of the oil and water level. He/she must present receipted bill in order to obtain reimbursement.
The lessee or proved drivers are criminally liable for infringements committed by them while driving the vehicle, as provided in the highway code.
The lessor can terminate the contract whenever he/she wishes through a telephone call or through sms.
It is understood and agreed that any dispute or claims arising under this agreement shall be subjected to the sole jurisdiction of the Courts of Kenya.
